This Terms of Use Agreement (this”Agreement’’) is a legal agreement between you (“User”) and Ezy Auto Tech Sdn Bhd that governs your use of this website. By  utilizing this Ezy Auto Tech Sdn Bhd website, User acknowledges that he or she has read, understood, and agrees to comply with the terms and conditions stated within this Agreement. Ezy Auto Tech Sdn Bhd may amend these terms and conditions at any time. User’s continued use of this website constitutes acceptance of the terms and condition stated at the time of use.

Ezy Auto Tech Sdn Bhd may collect information about the Users of its websites. Collection of this information is governed by the Ezy Auto Tech Sdn Bhd. Privacy Policy, which may be accessed here.

These third party sites are not under the control of Ezy Auto Tech Sdn Bhd and User  acknowledges that Ezy Auto Tech Sdn Bhd is not responsible or liable for any content, advertising, products or other materials available from such third party sites. User also agrees that Ezy Auto Tech Sdn Bhd shall not be liable for any loss or damage of any sort incurred as the result of using any third party’s website.

Ezy Auto Tech Sdn Bhd makes no warranty that this website will meet your requirements of that it will be uninterrupted, timely, secure or error free; nor does Impetus Technology Sdn Bhd make any warranty as to the results that may be obtained from the use of this website or as to the accuracy or reliability of any information obtained through this website. NOTE: SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

Indemnification
User agrees, at User’s expense, to indemnify, defend and hold harmless Ezy Auto Tech Sdn Bhd, its officers, directors, employees, agents, affiliates, distributors and licensees from and against any judgment, losses, deficiencies, damages, liability, costs and expenses (including reasonable attorney’s fees and expenses) incurred in connection with or arising from any claim, demand, suit, action or proceeding arising out of User’s breach of this Agreement or in connection with User’s use of this website or any product or service related thereto.

Venue and Governing Law 
This Agreement and the relationship between User and Ezy Auto Tech Sdn Bhd shall be governed by and construed in accordance with the laws of Malaysia. Any controversy or claim arising out of or relating to this Agreement or relating to use of this website and the material contained in this website shall be resolved in a federal or state court. User agrees that, regardless of any statute or law to contrary, any claim or cause of action arising out of or related to this Agreement must be filed within one (1) year after such claim or clause of action arises or it will be forever barred.

Waiver / Severability  
The waiver by either party of a breach or right under this Agreement will not constitute a waiver of any subsequent breach or right. If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, which will otherwise remain in full force and effect.

Reservation of Rights
Any rights not expressly granted herein are reserved.

2)      POLICY OF ORDER/ FORMATION OF PRODUCT AND DELIVERY

a)      All orders of the Products placed by Users whether made via the CCC or this Website shall be subject to acceptance by Ezy Auto Tech Sdn Bhd. Upon Users placing an order, a unique Purchase Order Number will be automatically generated and provided to Users to facilitate tracking of User's order. The provision of such Purchase Order Number does not operate as an acceptance of User's order and merely serves as confirmation that User's order has been received by Ezy Auto Tech Sdn Bhd.

b)      These terms and conditions shall become the Contract only when notice of acceptance by Ezy Auto Tech Sdn Bhd of an order by Users is sent to Users.

c)       Ezy Auto Tech Sdn Bhd reserves the right to limit quantities of the Products purchased in any order.

2.1    PRICE & PAYMENT

a)      Pricing of the Products shall be as stipulated in the official price lists published by Ezy Auto Tech Sdn Bhd from time to time in force as at the date of placement of orders by Users.

b)      Pricing of the Products quoted exclude delivery charges and all other extra charges.  

c)       All products sell will be charged in Malaysian Ringgit (MYR).

d)      I-Pay88-Ezy Auto will appear in User’s credit card statement.

2.2    DELIVERY

The delivery process will only be initiated after payment has been validated. Ezy Auto Tech Sdn Bhd shall endeavour to arrange to deliver the Products to the delivery point set by Users in his or her purchase order. Ezy Auto Tech Sdn Bhd will use its discretion in selecting a reputable carrier and appropriate means of shipment, and shall endeavour to notify the Users of the estimated date of delivery as soon as is reasonably possible. Any dates quoted by Ezy Auto Tech Sdn Bhd for delivery of the Products are estimates only and shall not form part of the Contract.

2.3  CHANGES

Ezy Auto Tech Sdn Bhd may update or discontinue any of Products and/or revise prices for the Products listed as available items on this Website or elsewhere at any time. Therefore, Users agrees that changes between the shipped Products and the Products described in marketing materials (advertisements, catalogues, specification sheets etc.) may occur. All orders are accepted on these terms, which supersede any other terms appearing in this Website or elsewhere and shall override any other terms referred to by the Users or in any course of dealing.

3)      RETURN

Ezy Auto Tech Sdn Bhd will not accept any return/exchange after product shipped for any reason including but not limited to damages, loss, (direct, indirect, punitive, actual, consequential, incidental, special, exempt or otherwise) resulting from delivery or during application. All paints are custom mixed for you when you place the order.  All returns must be shipped at your expenses.

4)      CANCELLATIONS

After User submit order and order confirmed by system, User cannot cancel order, all orders are processed immediately and once processed are subject to the same policy as Return.

5)      REFUSING AN ORDER

    If User refuse an order, user will not receive a refund. The order was custom made for User.

6)      COLOR MATCH PROBLEMS

User must select the correct color code from our database, Ezy Auto Tech Sdn Bhd not responsible for color match problem including but not limited to color may vary due to car repainted before, car paint faded from the sun or age, User wrongly select the color code and all kinds of problems occur during application.

Disclaimer :
Even though we'd like to, we can not watch over you while you use our products. You need to test the color before applying to your car. Our paint color is mixed base on original formula. We cannot do anything once the paint is applied to the car. We are not liable if you damage your car, so please be very careful. Also be safe. Keep Ezy touch up products and other paint products away from children. Ezy Touch-up paint is flammable and harmful or fatal if swallowed. Do not store in your car or in temperatures above 30 °C. Avoid from freezing. Dispose of paint products carefully respecting the environment regulations. Wear eye protection, proper respirator and disposable gloves. Protect your lungs. Touching up vehicles should be done outside in the shade or in a well ventilated area.
